Article Summary 2

In the article “Plain Language Movement and Legal Translation : An AnalyticalStudy of Two Translations of a Contract of Lease from Arabic into English”, Rafid Abdul explores the topic of simplifying the legal language in order to achieve a more comprehensive message, promoting the functional approach to translation.
The author argues that the Plain Language movement has had great positive effect on the translation practices of legal documents. He calls for implementing changes to the way translation is being taught, suggesting that more focus should be added towards the functional approach. The author points out a peculiar contradiction: the layman cannot understand the language of legal texts, even though they are specifically aimed towards him. This fact caused the Plain Language movement to emerge. The research itself is based on the analysis of two translations of the lease contracts. The translations are regarded as the best of their kind and are used in Iraqi universities. The analysis showed that the functional method, which implies using plain language instead of legal terms, had had no negative effect on the substance of the text, but made it overall easier to comprehend.
Ultimately, what Rafid Abdul is trying to convey through his work is that there should be more freedom given when it comes to translating legal texts, however such freedom must be strictly monitored. He also suggests that legal lexicon should be classified in accordance with its ability to change in translation: purely technical, semi-technical and everyday expressions.

Questions:
1) Is the situation in Russia similar at all?
2) Can Plain Language be applied to other spheres?
3) How are you today?

  1. Iwan,

thanks for sharing this article's summary with your peers and me. It gives a clear idea about the main points the article addresses and its logic is clear. What I did not understand is what you meant by the last question on the list of the Questions to the article. Was it meant as a joke or what?

    1. Oh, right, the last question. Honestly, I just couldn't come up with the third queston, so I put a "how are you" as a placeholder. I meant to come up with the actual quesion later, but never did. My apologies.
